The award recognizes the successful cooperation of our firms in the representation of our long-standing clients C&E Fein GmbH and Robert Bosch GmbH against Coram Tools GmbH before the Federal Patent Court of Switzerland. The proceedings were conducted by Dr. Michael Wallinger, together with attorney-at-law Thomas Schachl (partner).
The ruling of February 12, 2024 (Ref.: O2022_002) is considered a leading decision by the Swiss Federal Patent Court. It is of particular importance with regard to the calculation of the profit to be surrendered as part of the damages under patent law. This was preceded by a decision of the Federal Patent Court on infringement dated August 30, 2021 - O2019_012) which was confirmed by the Federal Supreme Court in its decision of February 11, 2022 - 4A_511/2021.
